Mesmo com pressão de entidades da sociedade civil, o Tribunal Regional Federal 1ª Região (TRF-DF) derrubou, no último dia 9, a liminar do Ministério Público de Rondônia que determinava a suspensão de audiências públicas nos distritos de Abunã, Mutum Paraná, Jaci-Paraná e Porto Velho.

As primeiras audiências foram em Jaci-paraná, no dia 10, e em Porto Velho no dia 11. Segundo Wesley Ferreira Lopes, da coordenação do Movimento dos Atingidos por Barragens (MAB), a participação do movimento foi fundamental nas audiências para o questionamento do EIA/RIMA. “O depoimento dos companheiros ribeirinhos que já foram atingidos por barragens deixavam claro que a construção delas não vinha atender as necessidades do povo”, afirmou Lopes.

As próximas audiências serão marcadas em 15 dias nos municípios de Abunã e Mutum Paraná. As entidades pretendem fazer audiências em mais lugares, como no município de Teotônio, para que mais atingidos possam discutir o estudo do Ibama. Além disso, pretendem incluir a discussão sobre as regiões da Bolívia que também serão afetadas com a construção das usinas do Complexo Rio Madeira.

Justiça de Rondônia paralisa processo de construção do complexo do Rio Madeira



A 3ª Vara da Seção Judiciária de Rondônia acatou o pedido de liminar dos Ministérios Públicos Federal e do Estado, suspendendo o processo de audiências públicas que antecedem a construção das hidrelétricas no Rio Madeira, na capital Porto Velho. A realização das audiências estava prevista de 08 a 11 de novembro e tinham como objetivo discutir com a comunidade os impactos do projeto. A liminar, concedida pelo juiz Élcio Arruda, alegava que a data marcada para as reuniões não corresponde ao prazo previsto nas normas ambientais - de 45 dias após a entrega do Estudo de Impacto Ambiental (EIA) concluído no final de setembro. Caso o Instituto Brasileiro do Meio Ambiente e dos Recursos Naturais Renováveis (Ibama) ou as empresas responsáveis pelo empreendimento descumprirem esta decisão, terão de pagar uma multa diária de R$ 10 mil.

Outro argumento utilizado na liminar aponta falhas no processo de licenciamento ambiental, que não prevê a área de 217 quilômetros que será inundada pela obra, atingindo diretamente 21 vilas e comunidades nas cercanias de Porto Velho. O Movimento dos Atingidos por Barragens (MAB) levanta outros problemas como o desaparecimento dos pequenos rios e a preocupação com o fluxo de madeira e a grande quantidade de mercúrio que o rio possui. O mercúrio quando impactado, vai para o subsolo, poluindo o lençol freático.

Segundo o Diretor de Secretaria da 3ª Vara de Rondônia, Roberto Ribeiro Camelo, no mesmo dia da decisão do juiz, o Ibama e a empreiteira Furnas Centrais Elétricas - responsável pela obra, recorreram da decisão, mas o pedido não foi aceito e o cancelamento das reuniões foi mantido. A partir de agora, as partes envolvidas poderão recorrer no Tribunal Regional Federal, em Brasília (DF). Enquanto esta liminar estiver em vigor, as audiências públicas só poderão ser realizadas depois que forem feitas as complementações pedidas pela Justiça no estudo ambiental.

Justice moves back and Ibama begins hearings on the Hydroelectric Complex of Rio Madeira


Even under pressure from civil society entities, the 1st Area’s Federal Regional Court (TRF-DF) dropped on 09/11 the temporary restraining order of the Public Ministry of Rondônia which determined the suspension of public hearings regarding the construction of the Rio Madeira Hydroelectric Complex in the districts of Abunã, Mutum Paraná, Jaci-Paraná and Porto Velho.



The Rio Madeira Complex that predicts the construction of two hydroelectric power plants in Rondônia, is in the final stage of the environmental licensing process. After the Environmental Impact Assessment Study (EIA/RIMA) went back and forth various times between the companies responsible for the project (Furnas and Odebrecht) and Ibama (Brazilian Institute of Environment and Renewable Natural Resources), the Environmental Licensing Authority marked the hearings despite fierce questioning by social movements.



The main argument used by the social movements - and accepted by the judge - was that the norms of the National Environmental Council (Conama) were not respected in the process. The organ stipulates that public hearings can be called on only 45 days after the submission of the RIMA.

After the rejection of the temporary restraining order, hearings already took place in Jaci-Paraná, on 10/11 and in Porto Velho on 11/11.



According to Wesley Ferreira Lopes from the coordination of MAB (Movement of the Dam Affected People), the participation of the movement was fundamental in the hearings questioning the EIA/RIMA. Lopes affirms that “the testimonies of our riverine comrades who have been already affected by dams, made clear that dam construction does not meet the needs of the people”.



The next hearings will take place in 15 days in the municipalities of Abunã and Mutum in Paraná. Civil society entities intend to carry out hearings in more places such as the municipality of Teotônio, so that more affected people can discuss the report of Ibama. In addition, they intend to discuss about the areas on Bolivia’s territory which will also be affected by the construction of the plants of the Rio Madeira Complex.





Rondônia’s Judiciary paralyzes the construction of Rio Madeira complex



To 3rd Jurisdiction of Rondônia in the capital Porto Velho, accepted the request from the Federal Public Ministry and the State for a temporary restraining order of the public hearing process that precedes the construction of the hydroelectric power plants in Rio Madeira. The public hearings which were planed between the 8th and 11th of November, were supposed to discuss the impacts of the project with the community. The temporary restraining order given by judge Élcio Arruda, alleged that the date marked for the hearings does not respect the period foreseen in the environmental legislation. That period is 60 days after the submission of the Environmental Impact Assessment Study (EIA) which was completed only in the end of September. In case the Brazilian Institute of Environment and Renewable Natural Resources - Ibama (by its abbreviation in Portuguese) or the companies responsible for the enterprise disobey this decision, they will have to pay a daily fine of R$ 10.000.



Another argument used in the temporary restraining order, points out flaws in the environmental licensing process, which did not address the 217 square kilometres area which will be flooded by the project and will affect directly 21 towns and communities around Porto Velho. The Movement of the Dam Affected People (MAB) points out further issues such as the disappearance of small rivers, the trunks flow and the great amount of mercury that the river contains. Mercury, when disturbed, is going underground and pollutes the aquifer.



According to the Director of Secretariat of the 3rd Jurisdiction of Rondônia, Roberto Ribeiro Camelo, on the same day of the judge's decision, Ibama and the contractor Furnas Centrais Elétricas - responsible for the project, appealed against the decision, but the request was not accepted and the restraining order of the hearings was maintained. >From now on, the involved parts can appeal to the Federal Regional Court in Brasília (DC). While this order is enforced, the public hearings will only be able to occur after the complementary requests made by the Judiciary in the environmental study, are satisfied.
